Terms and Conditions
Effective Date: June 30, 2026
These Terms and Conditions ("Agreement") govern your access to and use of the Schedule Helper software platform ("Software" or "Service"). By creating an account, starting a free trial, purchasing a subscription, or otherwise using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, do not access or use the Service.
1. About the Service
Schedule Helper is a subscription-based software platform designed to help service-based businesses create and manage recurring schedules using user-provided availability, preferences, business rules, and scheduling information.
The Service is intended to assist with scheduling decisions and administrative workflows. While the Software provides intelligent scheduling recommendations, users remain solely responsible for reviewing, approving, and implementing all schedules before they are communicated to employees, contractors, customers, students, or other third parties.
The Software is currently offered and operated as a product of Hope Marketing Solutions, LLC.
Hope Marketing Solutions, LLC reserves the right to improve, modify, expand, remove, or replace features at any time as the platform continues to evolve.
2. Eligibility
You must be at least eighteen (18) years old and legally capable of entering into a binding agreement to use the Service.
If you register on behalf of a business or organization, you represent that you have authority to bind that business or organization to these Terms.
3. Free Trial
New subscribers may be eligible for a seven (7) day free trial.
The free trial begins on the date your account is created.
A valid payment method is required to begin the trial.
Unless cancelled before the trial period ends, your subscription will automatically convert into a paid monthly subscription using the payment method provided during registration.
By enrolling in the free trial, you authorize Hope Marketing Solutions, LLC to automatically charge your selected payment method when the trial expires unless cancelled beforehand.
Only one free trial is permitted per business unless otherwise approved in writing.
Hope Marketing Solutions, LLC reserves the right to modify or discontinue promotional trial offers at any time.
4. Subscription Plans
Schedule Helper is offered as a recurring monthly subscription.
Available subscription plans, pricing, included features, and usage limits are displayed on the official sales page at the time of purchase.
Founder pricing, promotional pricing, or introductory offers are available only under the terms described at the time of enrollment and may not be combined with other offers unless specifically stated.
Future pricing changes may apply to new customers. Existing subscribers may retain promotional pricing only if specifically stated at the time of purchase.
Subscriptions automatically renew each billing cycle unless cancelled prior to renewal.
Applicable taxes may be added where required by law.
Hope Marketing Solutions, LLC reserves the right to modify subscription pricing for future billing periods by providing reasonable advance notice to affected subscribers.
5. Account Responsibility
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
You agree to provide accurate and complete registration information and to keep your account information current.
You are responsible for ensuring that the scheduling information, employee availability, customer availability, addresses, notes, preferences, and other information entered into the Software are accurate.
The quality of scheduling recommendations depends upon the accuracy of the information provided by the user.
Hope Marketing Solutions, LLC is not responsible for scheduling errors resulting from incomplete, inaccurate, outdated, or conflicting information entered by users.
6. Intellectual Property Rights
The Service, including all software, source code, object code, algorithms, scheduling logic, workflows, business rules, decision trees, artificial intelligence integrations, prompts, interface design, databases, graphics, text, documentation, training materials, videos, guides, reports, templates, features, functionality, and all future improvements or enhancements (collectively, the "Platform") are owned exclusively by Hope Marketing Solutions, LLC or its licensors and are protected by United States and international intellectual property laws.
Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for your own internal business operations during an active subscription.
No ownership rights are transferred to you through your use of the Service.
7. Proprietary Scheduling Methodology
The Platform incorporates proprietary scheduling methods, operational workflows, decision-making processes, business rules, and scheduling logic developed through substantial professional experience and investment.
These methods constitute confidential and proprietary intellectual property regardless of whether they are implemented through software code, artificial intelligence, documentation, training materials, or user-facing features.
You acknowledge that the value of the Platform extends beyond its software code and includes its unique scheduling methodology and operational framework.
8. Restrictions on Use
Except as expressly permitted in these Terms, you agree that you will not:
Copy, duplicate, reproduce, or distribute any portion of the Platform.
Sell, sublicense, lease, rent, or commercially exploit the Platform.
Reverse engineer, decompile, disassemble, decode, or otherwise attempt to discover the source code, algorithms, prompts, scheduling logic, or underlying methodology of the Platform.
Use the Platform or its outputs to develop or assist in developing a competing software product or service.
Copy, imitate, recreate, or replicate the Platform's scheduling workflows, business logic, algorithms, decision-making processes, or operational methodologies.
Remove or alter any copyright, trademark, or proprietary notices.
Circumvent subscription requirements, licensing restrictions, usage limitations, or security features.
Share login credentials with unauthorized users.
Allow third parties to access the Platform through your account except as permitted under your subscription plan.
Upload malicious code, viruses, bots, scripts, or other harmful technologies.
Use automated methods to scrape, extract, copy, harvest, or collect information from the Platform.
Use the Platform in violation of any applicable law or regulation.
Any unauthorized use immediately terminates your license to use the Service.
9. Artificial Intelligence Features
Certain features of the Platform may use artificial intelligence or automated decision-making technologies to assist in generating scheduling recommendations, identifying conflicts, optimizing routes, or suggesting scheduling alternatives.
These recommendations are generated based upon the information provided by users.
Artificial intelligence is intended to assist—not replace—human review and decision-making.
You are solely responsible for reviewing all schedules before implementation.
Hope Marketing Solutions, LLC does not guarantee that AI-generated recommendations will always be error-free, complete, or appropriate for every situation.
10. Customer Data
You retain ownership of the business information, schedules, customer information, employee information, notes, addresses, availability, preferences, and other data that you submit to the Platform ("Customer Data").
You grant Hope Marketing Solutions, LLC a limited license to store, process, analyze, transmit, and use Customer Data solely as necessary to provide, maintain, improve, secure, and support the Service.
This license terminates upon deletion of your Customer Data, except where retention is required by law or reasonably necessary for backup, security, fraud prevention, dispute resolution, or legal compliance.
Hope Marketing Solutions, LLC does not claim ownership of your Customer Data.
11. Feedback
If you provide suggestions, feature requests, ideas, recommendations, corrections, or other feedback regarding the Platform, you grant Hope Marketing Solutions, LLC a perpetual, worldwide, royalty-free, irrevocable license to use, modify, incorporate, publish, and commercialize such feedback without compensation or obligation to you.
You acknowledge that customer feedback may be incorporated into future versions of the Platform for the benefit of all users.
12. Payment and Billing
Subscription fees are billed in advance on a recurring monthly basis using the payment method provided during registration.
By subscribing to the Service, you authorize Hope Marketing Solutions, LLC and its authorized payment processors to charge your selected payment method for all applicable subscription fees, taxes, and other authorized charges.
If a payment cannot be processed, Hope Marketing Solutions, LLC may suspend or terminate access to the Service until payment is successfully received.
You are responsible for maintaining current billing information, including payment methods and billing contact information.
13. Automatic Renewal
Unless cancelled before your next billing date, your subscription will automatically renew for successive monthly billing periods.
You authorize recurring charges until your subscription is cancelled in accordance with these Terms.
You may cancel your subscription at any time through your account settings, if available, or by contacting customer support using the contact information provided on the Schedule Helper website.
Cancellation prevents future billing but does not entitle you to a refund for the current billing period unless otherwise required by law.
14. Cancellation and Account Closure
You may cancel your subscription at any time.
Your subscription will remain active through the end of the billing period already paid for unless otherwise stated.
After cancellation:
Access to the Platform will end at the expiration of your current billing period.
Certain account information may remain temporarily available for administrative, billing, legal, security, or backup purposes.
Customer Data may be permanently deleted after account closure in accordance with our data retention practices.
It is your responsibility to export or retain any information you wish to keep before your subscription ends.
Hope Marketing Solutions, LLC is not responsible for the loss of Customer Data following account termination.
15. Refund Policy
Because access to the Platform and its features is provided immediately upon account activation, subscription fees are generally non-refundable.
No refunds or credits will be issued for:
Partial billing periods.
Unused subscriptions.
Failure to use the Platform.
Early cancellation.
Nothing in this section limits any rights you may have under applicable consumer protection laws.
16. Availability of Service
Hope Marketing Solutions, LLC strives to provide a reliable and secure software platform.
However, uninterrupted or error-free operation cannot be guaranteed.
The Platform may occasionally be unavailable due to:
Scheduled maintenance.
Software updates.
Security enhancements.
Internet service interruptions.
Third-party service outages.
Circumstances beyond our reasonable control.
Features, functionality, and integrations may be modified, added, improved, or discontinued at any time to improve the Service.
17. Founder's Launch
The Platform may be offered through a Founder's Launch or early-access program.
During this period, subscribers acknowledge that:
New features will be added regularly.
Existing functionality may be enhanced or refined.
User feedback may directly influence future development.
Certain features may evolve over time as the Platform continues to improve.
Participation in the Founder's Launch provides early access to the Platform but does not guarantee any specific future feature unless expressly stated in writing.
18. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE."
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOPE MARKETING SOLUTIONS, LLC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO:
MERCHANTABILITY.
FITNESS FOR A PARTICULAR PURPOSE.
NON-INFRINGEMENT.
ACCURACY.
RELIABILITY.
UNINTERRUPTED AVAILABILITY.
Hope Marketing Solutions, LLC does not warrant that:
The Platform will meet every business requirement.
Scheduling recommendations will always be correct.
Artificial intelligence outputs will be error-free.
The Platform will operate without interruption.
All software defects will be corrected immediately.
Users remain responsible for reviewing scheduling decisions before implementation.
19. Limitation of Liability
To the fullest extent permitted by law, Hope Marketing Solutions, LLC shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to the use of the Platform.
This includes, without limitation:
Lost profits.
Lost revenue.
Business interruption.
Lost business opportunities.
Lost goodwill.
Loss of data.
Scheduling errors.
Employee or contractor disputes.
Customer cancellations.
Travel inefficiencies.
In no event shall the total liability of Hope Marketing Solutions, LLC exceed the total subscription fees actually paid by you during the twelve (12) months immediately preceding the event giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you.
20. Indemnification
You agree to defend, indemnify, and hold harmless Hope Marketing Solutions, LLC, its owners, officers, employees, contractors, affiliates, successors, and agents from any claims, damages, liabilities, losses, costs, or expenses, including reasonable attorneys' fees, arising out of or relating to:
Your use of the Platform.
Your Customer Data.
Your violation of these Terms.
Your violation of applicable laws or regulations.
Your infringement of any third-party rights.
Scheduling decisions you make based on recommendations generated by the Platform.
21. Suspension and Termination
Hope Marketing Solutions, LLC reserves the right to suspend or terminate your access to the Platform, with or without notice, if you:
Violate these Terms.
Fail to pay applicable subscription fees.
Engage in fraudulent, deceptive, or unlawful conduct.
Attempt to interfere with the security or operation of the Platform.
Misuse or abuse the Service.
Infringe upon the intellectual property rights of Hope Marketing Solutions, LLC or any third party.
Termination does not relieve you of any payment obligations that accrued before termination.
Sections relating to intellectual property, confidentiality, payment obligations, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution shall survive termination of this Agreement.
22. Confidentiality
During your use of the Platform, you may have access to confidential or proprietary information relating to the Platform, its features, business methods, scheduling processes, documentation, or future development plans.
You agree not to disclose, reproduce, distribute, publish, or otherwise use such confidential information except as necessary to use the Platform in accordance with these Terms.
This obligation survives termination of your subscription.
23. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law principles.
24. Dispute Resolution
The parties agree to first attempt to resolve any dispute through good-faith discussions.
If a dispute cannot be resolved informally, either party may pursue any remedies available under applicable law in the state or federal courts located in the State of Tennessee.
You consent to the exclusive jurisdiction and venue of those courts.
Nothing in these Terms prevents Hope Marketing Solutions, LLC from seeking injunctive or equitable relief to protect its intellectual property, confidential information, or other proprietary rights.
25. Force Majeure
Hope Marketing Solutions, LLC shall not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including but not limited to natural disasters, acts of God, governmental actions, labor disputes, cyberattacks, internet outages, utility failures, pandemics, acts of terrorism, or failures of third-party service providers.
26. Third-Party Services
The Platform may integrate with or rely upon third-party services, including but not limited to payment processors, mapping providers, communication platforms, cloud hosting providers, artificial intelligence providers, analytics services, and email delivery services.
Hope Marketing Solutions, LLC is not responsible for the availability, accuracy, policies, or performance of third-party services.
Your use of those services may also be subject to their own terms and privacy policies.
27. Changes to These Terms
Hope Marketing Solutions, LLC may update these Terms from time to time.
When material changes are made, we will update the Effective Date and provide notice through the Platform, by email, or by other reasonable means.
Your continued use of the Platform after updated Terms become effective constitutes your acceptance of the revised Terms.
28. Entire Agreement
These Terms, together with the Privacy Policy and any additional policies expressly incorporated by reference, constitute the entire agreement between you and Hope Marketing Solutions, LLC regarding the Platform.
They supersede all prior discussions, representations, agreements, or understandings relating to the Service.
29. Severability
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
30. No Waiver
Failure by Hope Marketing Solutions, LLC to enforce any provision of these Terms shall not constitute a waiver of any right or provision.
31. Assignment
You may not assign or transfer your rights or obligations under these Terms without the prior written consent of Hope Marketing Solutions, LLC.
Hope Marketing Solutions, LLC may assign these Terms as part of a merger, acquisition, sale of assets, corporate restructuring, or other business transaction.

33. Electronic Acceptance
By creating an account, beginning a free trial, purchasing a subscription, checking the acceptance box during registration, or otherwise using the Platform, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions.
Your electronic acceptance has the same force and effect as a handwritten signature.
